These Terms and Conditions ("Terms") govern your access to and use of the Dramance.Curated platform and related services (the "Platform").
By accessing or using the Platform — as a visitor, a collector, or a submitting artist — you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Platform.
1. About the Platform
Dramance.Curated is a curated gallery platform that showcases selected works of art and design objects chosen by the curator, together with links to external marketplaces or sellers where such works may be purchased.
The Platform does not itself sell, ship, or fulfill orders for any artwork or object. Any purchase link leads to a third-party seller, marketplace, or the artist's own storefront, and the transaction takes place entirely outside the Platform.
The Platform is intended for discovery, presentation, and promotion of art and objects. It is not a marketplace, auction house, or payment processor.
2. Curation Disclaimer
All works featured on the Platform are selected at the sole discretion of the curator based on artistic, aesthetic, or editorial criteria.
Featuring a work on the Platform:
- does not constitute an endorsement of the artist's or seller's business practices;
- does not guarantee availability, price accuracy, or condition of the work at the linked destination;
- should not be interpreted as investment advice or a guarantee of value.
Users understand that all purchase decisions are made independently, on the third-party seller's own terms.
3. Eligibility
You must be at least 18 years old, or the legal age of majority in your jurisdiction, to submit work to the Platform or to register an account. Visitors browsing public gallery pages without an account are not required to meet this age threshold unless local law requires otherwise.
By submitting work or creating an account, you confirm that you meet this requirement.
4. Accounts and Access
The Platform may allow access through:
- email or social sign-in (e.g. Google authentication);
- device-based identifiers.
You are responsible for maintaining access to your account credentials.
The operator is not responsible for loss of access caused by:
- device changes,
- deletion of the application or loss of local data,
- loss of access to third-party authentication providers.
5. Artist Policy & Curation Terms
This section applies specifically to artists and creators who submit work for curation and display on the Platform ("Artists").
5.1 Intellectual Property
Artists retain 100% of the copyright and all other intellectual property rights in their submitted works at all times. Submitting a work for curation does not transfer ownership or any exclusive rights to the operator.
By submitting a work, the Artist grants the operator a limited, non-exclusive, revocable license to display and promote the work (and associated images, title, and description) on the Platform and its official social media and marketing channels, solely for the purpose of showcasing the work and directing visitors to the Artist's sale link. The operator does not acquire the right to sell, license, modify, or sublicense the underlying work itself.
5.2 Founder Phase
During the initial launch phase of the Platform ("Founder Phase"), submissions and gallery features carry a 0% platform fee. The Founder Phase and its end date will be communicated to participating Artists in advance.
5.3 Future Sales & Drops
Any future commercial print drops, limited editions, or marketplace integrations facilitated directly through the Platform will operate on a standard 80/20 royalty split (80% to the Artist, 20% to the gallery), unless a different split is agreed individually in writing between the Artist and the operator prior to the launch of that specific drop or integration.
This royalty split applies only to sales made through Platform-facilitated drops or integrations. It does not apply to sales made through the Artist's own external links, shops, or marketplaces featured for discovery purposes, from which the operator receives no share unless separately agreed.
5.4 Removal and Right to Decline
The operator reserves the right to decline or remove any submission from the gallery at its discretion, including after initial acceptance, for reasons such as rights disputes, quality standards, or policy violations. Artists may also request removal of their own work at any time by contacting the operator.
5.5 Accuracy of Submissions
By submitting a work, the Artist represents that they own the rights to the submitted work (or have the necessary permissions), that the work does not infringe third-party rights, and that any sale link provided is accurate and under the Artist's control or authorization.
6. Purchases and Third-Party Sellers
All purchases of featured works are made directly with the linked third-party seller, marketplace, or Artist. The operator is not a party to any such transaction and does not process payments, handle shipping, or guarantee authenticity, condition, or delivery.
Any dispute regarding a purchase (payment, shipping, authenticity, returns, refunds) must be resolved directly between the buyer and the seller/Artist in accordance with the seller's own terms.
7. Intellectual Property of the Platform
All content created by the operator, including but not limited to:
- gallery layout, structure, and design;
- curatorial text, descriptions, and editorial content;
- the Platform's branding, logo, and visual identity,
is owned by the operator or used under appropriate license. You may not copy, reproduce, distribute, modify, or exploit any part of the Platform (excluding the Artists' own works, which remain the Artists' property under Section 5.1) without prior written permission from the operator.
8. Prohibited Use
You agree not to:
- use the Platform for unlawful purposes;
- submit work that you do not have the rights to submit;
- misrepresent the authorship, authenticity, or availability of a submitted work;
- disrupt or interfere with the operation of the Platform.
9. Limitation of Liability
To the maximum extent permitted by applicable law, the operator shall not be liable for:
- the outcome, authenticity, condition, or delivery of any purchase made through a third-party link;
- disputes between buyers and Artists or sellers;
- loss of data;
- indirect or consequential damages resulting from the use of the Platform.
Use of the Platform is at your own discretion and risk.
10. Termination
The operator reserves the right to suspend or terminate access to the Platform, or remove a submitted work, if these Terms are violated, misuse of the Platform is detected, or termination is required by applicable law.
11. Changes to Terms
These Terms may be updated from time to time.
Continued use of the Platform after changes are published constitutes acceptance of the updated Terms. Material changes affecting the Artist Policy (Section 5) will be communicated to registered Artists in advance where reasonably possible.
12. Governing Law
These Terms shall be governed and interpreted in accordance with applicable laws, without regard to conflict of law principles.
